These Terms & Conditions (“Terms”) govern access to and use of the Archi Finance platform, website, and related services (collectively, the “Service”) operated by Lusso Bangladesh Ltd and its affiliates (“we”, “us”, or the “Platform Owner”). By creating an account, starting a workspace, or using the Service, you agree to these Terms and our Privacy Policy below.
1. Acceptance of terms
You must read, understand, and accept these Terms before using the Service. If you do not agree, do not register or use Archi Finance. If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Service description
Archi Finance provides cloud-based finance management tools for businesses, including invoicing, jobs, expenses, payroll-related records, dashboards, imports/exports, and related features. Features may vary by plan, trial status, region, or platform configuration. We may add, modify, suspend, or remove features at any time.
3. Platform discretion & right to serve
The Platform Owner reserves sole discretion to accept, decline, suspend, or terminate any account, workspace, or user access at any time, with or without notice, for any lawful reason including security concerns, abuse, non-payment, legal compliance, or operational requirements. We are not obligated to provide the Service to any person or organization.
4. Accounts & registration
- You must provide accurate, current registration information including company name, contact name, email, and phone number.
- You are responsible for safeguarding login credentials and all activity under your account.
- You must notify us promptly of unauthorized access or suspected security incidents.
- One person may not maintain multiple trial workspaces to evade plan limits unless explicitly permitted.
5. FREE access, subscriptions & billing
- New workspaces may be offered complimentary access. Eligibility, duration, and included features are determined solely by the Platform Owner and may change at any time.
- We may shorten, extend, pause, or end complimentary access at any time, with or without notice.
- During complimentary access, we may enable or restrict any feature, module, export, user limit, or integration at our discretion.
- Paid plans, pricing, taxes, currencies (including BDT, USD, and AED where available), and billing cycles are shown at checkout or in your workspace settings.
- Failure to pay applicable fees may result in suspension or termination of access.
6. Data, backups & availability
Data backup is not included in the standard Service. Unless you purchase a separate data backup add-on or a plan that explicitly includes backup services, we do not guarantee retention, restoration, or archival copies of your data.
- Without an active paid backup service, you are solely responsible for exporting and maintaining your own copies of business records.
- We do not accept liability for loss, corruption, deletion, or unavailability of data caused by technical failures, maintenance, user error, third-party outages, security incidents, or account termination.
- Optional backup services, if offered, may be subject to additional fees, retention limits, and separate terms.
- We may perform maintenance that temporarily limits availability. We strive for reliability but do not guarantee uninterrupted or error-free operation.
7. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes.
- Upload malware, attempt unauthorized access, or interfere with platform security or performance.
- Reverse engineer, scrape, or resell the Service except where permitted by law.
- Misrepresent your identity, impersonate others, or infringe intellectual property or privacy rights.
- Use the Service to store or process data you do not have the right to use.
8. Privacy policy
We collect and process information necessary to operate the Service, including:
- Account data: name, email, phone number, company/workspace name, billing details, and authentication logs.
- Business data: invoices, jobs, expenses, payroll records, attachments, and other content you enter into the Service.
- Technical data: IP address, device/browser information, usage events, and security diagnostics.
We use this information to provide and improve the Service, secure accounts, communicate with you, process payments, comply with law, and prevent abuse. We do not sell personal information. We may share data with trusted processors (hosting, email, payment providers) under contractual safeguards, or when required by law.
You are the controller of your business records entered into the Service. You must obtain any required consents from employees, clients, or vendors whose personal data you upload. Contact us to request access, correction, or deletion of account information where applicable.
9. Intellectual property
The Service, branding, software, and documentation are owned by the Platform Owner or its licensors. You retain ownership of content you submit. You grant us a limited license to host, process, and display your content solely to operate the Service.
10. Confidentiality & security
We implement reasonable administrative, technical, and organizational measures to protect the Service. No online system is completely secure. You are responsible for configuring user roles appropriately within your workspace.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ARCHI FINANCE IS A BUSINESS TOOL AND DOES NOT PROVIDE LEGAL, TAX, ACCOUNTING, OR FINANCIAL ADVICE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100) IF NO FEES WERE PAID.
13. Indemnification
You agree to indemnify and hold harmless the Platform Owner from claims, damages, and expenses arising from your use of the Service, your content, violation of these Terms, or violation of applicable law.
14. Suspension & termination
We may suspend or terminate your access immediately for breach of these Terms, non-payment, security risk, or at our discretion. You may stop using the Service at any time. Upon termination, your right to access the Service ends. Provisions that by nature should survive (including data disclaimers, limitation of liability, and indemnity) will survive termination.
15. Changes to these Terms
We may update these Terms at any time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service.
16. Governing law & disputes
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles. Courts located in Dhaka, Bangladesh shall have exclusive jurisdiction, unless otherwise required by mandatory local law.
